These SMS Terms and Conditions ("SMS Terms") govern participation in ORN Workforce Notifications, a text-messaging program operated by The Simon Agency, LLC ("The Simon Agency," "TSA," "we," "our," or "us") through the Operational Readiness Network ("ORN").
By voluntarily enrolling in ORN Workforce Notifications, you agree to these SMS Terms. These SMS Terms supplement our Privacy Policy and any other agreement or policy that applies to your relationship with TSA. If these SMS Terms conflict with another agreement solely concerning the ORN text-messaging program, these SMS Terms control for that program.

Messages will identify The Simon Agency, ORN, or both as the sender.
ORN Workforce Notifications provides recurring, nonmarketing workforce and assignment-related text messages to eligible employees, contractors, and ORN members who have expressly opted in.

ORN Workforce Notifications is not a marketing or promotional program. Enrollment in this program does not authorize TSA to send marketing text messages. Marketing messages, if ever offered, would require any separate consent required by law and would be governed by the terms applicable to that program.
Enrollment is voluntary. You enroll by providing a valid mobile telephone number and affirmatively selecting a separate SMS-consent checkbox through an authorized TSA or ORN web form. The checkbox is not selected by default.
Consent to receive ORN text messages is not a condition of employment, contractor engagement, ORN membership, purchasing services, or eligibility for an assignment. Accepting another agreement, acknowledging the Privacy Policy, creating a profile, or providing a telephone number does not by itself constitute consent to receive text messages.
By enrolling, you represent that:
Consent applies only to ORN Workforce Notifications and may not be transferred or treated as consent to another messaging campaign.
Message frequency varies based on assignment opportunities, your availability responses, assignment status, operational activity, and administrative needs. You may receive multiple messages concerning a single assignment opportunity or active assignment. Periods with no relevant activity may result in no messages.
Message and data rates may apply. TSA does not charge a separate fee to participate in ORN Workforce Notifications, but your wireless carrier may charge for sent or received messages or data under your mobile-service plan. You are responsible for any carrier charges.
You may cancel ORN Workforce Notifications at any time by replying STOP to a program message. Supported opt-out keywords may also include END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, REVOKE, or OPTOUT.
After your opt-out request is processed, you will receive a confirmation message and no further messages will be sent through the ORN campaign unless you subsequently enroll again. A STOP request applies to the messaging program associated with the sending number and may prevent TSA from sending additional ORN messages to that number.
Opting out of text messages does not, by itself, terminate your employment, contractor relationship, ORN profile, or assignment eligibility. However, you will be responsible for monitoring and using other communication methods that TSA authorizes and makes available for operational information.
To enroll again after opting out, follow the current ORN enrollment process or contact TSA Operations for assistance. Do not assume that submitting a new telephone number or profile update automatically restores SMS consent.

Replies may be processed automatically and are not monitored continuously for emergencies. Do not use the ORN SMS number to report an emergency or request emergency assistance. Call 911 or the appropriate local emergency number when immediate police, fire, or medical assistance is required.
Text-message delivery is subject to wireless-carrier networks, device compatibility, service availability, system performance, and circumstances outside TSA's control. Messages may be delayed, blocked, duplicated, misdirected, or not delivered.
Carriers are not liable for any delayed or undelivered messages. TSA does not guarantee the timing, security, or delivery of any message and is not responsible for a recipient's failure to receive or review an ORN message.
An ORN text message does not replace a formal assignment confirmation, post order, contract, emergency instruction, or other communication when TSA identifies another record or channel as controlling.
Program messages may contain links to TSA or ORN webpages, forms, assignment records, or other authorized resources. Do not forward assignment-specific links, access codes, client information, locations, itineraries, or operational instructions to unauthorized persons.
TSA will not request your password, full Social Security number, or complete payment-card information through an unsolicited ORN text message. If you question whether a message is authentic, do not select its links; contact TSA Operations using the information in Section 7.
You must promptly notify TSA if you stop using, transfer, disconnect, or reassign the mobile number enrolled in the program. Until our records are updated, messages may continue to be sent to the enrolled number. You are responsible for keeping your contact information current and for protecting confidential information displayed on your device.
Our collection and use of personal information associated with ORN Workforce Notifications are described in our Privacy Policy.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be sold, rented, transferred, or shared with third parties for their independent use. We may provide limited information to service providers solely to operate and deliver the messaging program, process consent and opt-out requests, maintain security, or comply with law. Those providers may not use the information for their own marketing or promotional purposes.
TSA may suspend, modify, or discontinue ORN Workforce Notifications, or restrict an individual's participation, when reasonably necessary for security, compliance, operational, technical, or legal reasons. Discontinuation of the messaging program does not alter other agreements, assignments, duties, or obligations between TSA and the participant.
We may update these SMS Terms to reflect changes in the program, technology, carrier requirements, law, or our practices. The revised version will be posted with a new "Last Updated" date. When required, we will provide additional notice or obtain new consent before a material change takes effect.
Your continued receipt of messages after an update does not eliminate any right to opt out. You may reply STOP at any time.
